President Biden Announces New Immigration Process to Promote Family Unity

President Biden recently announced executive action directing the  Department of Homeland Security (DHS)  to implement a new process aimed at promoting family unity, aligning with the Biden-Harris Administration’s commitment to keeping families together.

This initiative leverages existing legal authorities to help noncitizen spouses of U.S. citizens secure lawful permanent residence without the prolonged separations that many currently endure.

Addressing a Critical Challenge

Under current immigration laws, many noncitizens married to U.S. citizens must leave the United States to apply for lawful permanent residence.

And many require a waiver for unlawful presence which now carries processing times upwards of 3.5 years. This requirement often results in extended periods of stress and in some cases separation, causing significant hardship for families.

The new  process seeks to mitigate these challenges by allowing certain noncitizen spouses to apply for permanent residency without having to depart the U.S.

Who is Eligible?

To be eligible for this new process, noncitizens must:

– Have lived continuously in the U.S. for at least 10 years as of June 17, 2024.

– Be married to a U.S. citizen as of June 17, 2024.

– Pose no threat to public safety or national security.

– Merit a favorable exercise of discretion.

Additionally, children of these noncitizens may also be considered for parole if they meet certain criteria.

The application window for this process is expected to be brief due to anticipated litigation. Therefore, it is crucial for eligible individuals to start gathering the necessary documentation immediately, especially proof of 10 years of continuous physical presence in the U.S.
